Subject Overview:

Objectives:

A candidate who has successfully completed the subject should:

  • Be aware of key features of the Victorian Charter of Human Rights and Responsibilities
  • Be familiar with the methodology of its interpretation
  • Understand the principal similarities and differences between the Victorian Charter and other domestic Bills of Rights
  • Be able to evaluate the relevance of comparative human rights experiences to Australian circumstances.

Syllabus:

Principal topics will include:

  • The interpretation and application of the Charter
  • Criminal procedure rights
  • Freedom of expression
  • Privacy
  • Discrimination
  • Property rights.
Assessment:
  • Research paper 10,000 words (100%) (29 January 2009) (topic approved by the subject coordinator)
