Applicants without legal qualifications should note that subjects are offered in the discipline of law at an advanced graduate level. While every effort will be made to meet the needs of students trained in other fields, concessions will not be made in the general level of instruction or assessment. Most subjects assume the knowledge usually acquired in a degree in law (LLB, JD or equivalent). Applicants should note that admission to some subjects in the Melbourne Law Masters will be dependent upon the individual applicant’s educational background and professional experience.

This subject will provide an understanding of the World Trade Organization (WTO) Trade-Related Property Rights (TRIPS) Agreement and subsequent WTO instruments, and the debates in relation to public health. The two lecturers are from the WTO and are experts on the workings of the WTO and the TRIPS agreement.

Principal topics will include:

• Provisions of the TRIPS Agreement relevant to public health: Negotiations and disputes
• Economics of the pharmaceutical sector
• Subsequent World Trade Organization (WHO) instruments: Negotiations and usage
• National implementing legislation, FTAs
• Relevant work in the WHO.

A student who has successfully completed this subject should:

• Be able to understand the World Trade Organization (WTO) Trade-Related Property Rights (TRIPS) Agreement and subsequent WTO instruments and the debates in relation to public health
• Be able to understand better the working of the WTO.
